Welcome to NoMoreSmoke. These Terms of Service ("Terms") govern your use of the NoMoreSmoke mobile application ("App") provided by NoMoreSmoke ("we," "us," or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Description of Service
NoMoreSmoke is a mobile application designed to help users track and reduce their smoking, vaping, or other nicotine use. The App provides:

2. Eligibility
You must be at least 17 years of age to use this App. By using the App, you represent that you meet this age requirement.
3. Account Registration

You may create an account using:
- Apple Sign In
- Email and password
You are responsible for maintaining the confidentiality of your account credentials.

You agree to:

- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
4. Subscriptions and Payments
4.1 Premium Features
Certain features require a paid subscription ("Premium"). Premium subscriptions are offered on monthly and yearly billing cycles.
4.2 Pricing
Current subscription prices are displayed in the App. Prices may vary by region and are subject to change with notice.
4.3 Free Trials
We may offer free trial periods. If you do not cancel before the trial ends, you will be automatically charged the subscription fee.
4.4 Billing
- Subscriptions are billed through Apple's App Store
- Payment is charged to your Apple ID account
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
4.5 Cancellation and Refunds
- You may cancel your subscription at any time through your App Store settings
- Cancellation takes effect at the end of the current billing period
- No refunds are provided for partial periods
- Refund requests must be directed to Apple
5. User Conduct
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the App's functionality
- Upload harmful content, malware, or viruses
- Impersonate others or misrepresent your identity
- Violate any applicable laws or regulations
6. User Content
6.1 Your Content
You retain ownership of content you create (e.g., motivation photos, journal entries). By uploading content, you grant us a license to store, display, and process it for the purpose of providing the App's services.
6.2 Content Guidelines
You agree not to upload content that is:
- Illegal, harmful, or offensive
- Infringing on intellectual property rights
- Containing personal information of others without consent
7. Health Disclaimer
IMPORTANT: NoMoreSmoke is a wellness and tracking tool, NOT a medical device or treatment.

- Health timelines and milestones are based on general research and may not apply to your specific situation
- Always consult a healthcare professional for medical advice
- If you experience serious withdrawal symptoms, seek medical attention
- We make no guarantees regarding cessation outcomes
8. Intellectual Property
8.1 Our Rights
The App, including its design, features, content, and code, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.
8.2 Trademarks
"NoMoreSmoke" and our logo are trademarks. You may not use them without our prior written consent.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
- WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
11. Termination
11.1 By You
You may delete your account at any time through the App settings or by contacting us.
11.2 By Us
We may suspend or terminate your access if you violate these Terms or engage in harmful conduct.
11.3 Effect of Termination
Upon termination, your right to use the App ceases. We may delete your data in accordance with our Privacy Policy.
12. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated through the App. Continued use after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of Poland, without regard to conflict of law principles. Disputes shall be resolved in the courts of Poland.
14. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
