These Terms of Service ("Terms") govern your access to and use of the MaxxUp mobile application ("MaxxUp", "the App", "we", "us", or "our").
By downloading, accessing, purchasing, or using MaxxUp, you agree to these Terms. If you do not agree, do not use the App.
MaxxUp is an AI-powered appearance self-improvement and habit-building app. The App may allow you to take or upload a selfie, answer onboarding questions, receive AI-generated appearance insights, view scores and recommendations, follow daily routines, complete tasks, earn XP, build streaks, and track progress over time.
MaxxUp is provided for informational, educational, motivational, and self-improvement purposes only.
MaxxUp does not provide medical, dermatology, dental, mental health, nutrition, fitness, cosmetic, legal, or other professional advice.
The App's scores, recommendations, summaries, progress estimates, and AI outputs are generated by automated systems and app logic. They may be inaccurate, incomplete, subjective, or inappropriate for your personal circumstances.
You should not rely on MaxxUp as a substitute for professional advice. Before making significant changes to your diet, exercise, skincare, supplements, health routines, dental care, or any treatment, consult a qualified professional.
If you have a medical condition, skin condition, eating disorder, body image concern, mental health concern, injury, or any other health-related issue, do not rely on MaxxUp. Seek advice from a qualified professional.
MaxxUp uses AI and app logic to generate appearance-related scores and recommendations. These outputs are estimates for self-improvement guidance only.
You understand and agree that:
You must be at least 13 years old to use MaxxUp. If you are under 18, you may use the App only with permission and supervision from a parent or legal guardian.
By using MaxxUp, you represent that you meet these requirements and that you have the legal capacity to agree to these Terms.

Do not upload photos of other people without their permission. Do not use MaxxUp to analyze, judge, harass, shame, bully, exploit, or discriminate against another person.

We may suspend, restrict, or terminate access if we believe you have violated these Terms or used the App in a harmful or unlawful way.
You retain your rights in photos and other content you submit to MaxxUp. By submitting content, you grant us a limited, non-exclusive, worldwide, royalty-free license to process, transmit, display, store, and use that content only as necessary to provide, maintain, secure, and improve the App and comply with legal obligations.
You represent that you have all rights and permissions needed to submit the content.
We do not claim ownership of your selfies. We do not use selfies for face recognition, identity verification, or authentication.
MaxxUp may rely on third-party services, including:
Your use of MaxxUp may involve these third-party services. Their own terms, privacy policies, retention practices, and availability apply. We do not control third-party services and are not responsible for their actions, downtime, security incidents, policy changes, or processing practices.

MaxxUp may be free to download and may offer optional paid premium access, including monthly or annual subscriptions.
Premium features may include full AI analysis, detailed score breakdowns, personalized recommendations, daily routines, progress tracking, streaks, levels, reminders, and other features described in the App.
Payments are charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account may be charged for renewal within 24 hours before the end of the current billing period.
You can manage or cancel subscriptions in your Apple ID subscription settings. Deleting the App does not cancel your subscription.
Refunds are handled by Apple according to Apple's policies. We do not control Apple's refund decisions.
We may change subscription features, pricing, trial availability, or premium offerings from time to time, subject to applicable law and App Store rules.
If MaxxUp offers a free trial, promotional price, or introductory offer, the terms shown in the App Store or purchase screen apply. Unless canceled before the trial or promotional period ends, your subscription may automatically convert to a paid subscription.
Only one trial or promotional offer may be available per user or Apple ID unless Apple or the App indicates otherwise.
We may update, modify, suspend, or discontinue any part of MaxxUp at any time. Features may change, become unavailable, or require a subscription.
We do not guarantee that the App will always be available, uninterrupted, error-free, or compatible with every device, iOS version, region, or third-party service.
AI features may fail, return unexpected results, or be unavailable due to network issues, provider limits, provider downtime, policy changes, safety systems, or other reasons.
To the maximum extent permitted by applicable law, MaxxUp is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.
We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that MaxxUp will meet your expectations, produce accurate results, improve your appearance, improve your confidence, or achieve any specific outcome.
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of profits, emotional distress, personal dissatisfaction, reputational harm, subscription issues, device issues, or damages arising from your use of or inability to use the App.
To the maximum extent permitted by applicable law, our total liability for any claim arising out of or relating to the App or these Terms will not exceed the greater of: (a) the amount you paid to us through the App in the three months before the claim arose, or (b) USD $50.
Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above limitations may not apply to you.
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless MaxxUp, its owners, employees, contractors, service providers, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or related to:
MaxxUp, including its design, interface, branding, software, source code, text, graphics, icons, workflows, and other materials, is owned by us or our licensors and is protected by intellectual property laws.
These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, subject to these Terms and Apple's App Store rules.
You may not copy, reproduce, distribute, sell, lease, modify, create derivative works from, reverse engineer, decompile, or attempt to extract the source code of the App except where such restriction is prohibited by law.
The App is distributed through Apple's App Store. Your use of the App is also subject to Apple's applicable terms, including the Apple Media Services Terms and Apple's Standard End User License Agreement, unless a custom license applies.
Apple is not responsible for providing maintenance or support for MaxxUp, except as required by applicable law. Apple and its subsidiaries are third-party beneficiaries of these Terms to the extent required by Apple's App Store terms.
Your use of MaxxUp is also governed by our Privacy Policy, which explains how information is collected, used, stored, and shared.

You may stop using MaxxUp at any time. You may delete the App from your device. Deleting the App does not automatically cancel any active subscription.
We may suspend, restrict, or terminate your access to the App if we believe you violated these Terms, created legal risk, harmed others, misused the App, or if we discontinue the App.
Upon termination, your right to use the App ends immediately. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, privacy, governing law, and dispute provisions.
We may update these Terms from time to time. When we do, we will update the "Last Updated" date above. If changes are material, we may provide additional notice as required by law.
Your continued use of MaxxUp after updated Terms become effective means you accept the updated Terms.
These Terms are governed by the laws applicable in the jurisdiction where MaxxUp is located, without regard to conflict of law rules, unless consumer protection laws in your jurisdiction require otherwise.
If you live in the European Union, United Kingdom, Switzerland, Norway, Iceland, or another jurisdiction with mandatory consumer protection rules, you may have rights under the laws of your usual place of residence.
Before bringing a formal claim, you agree to contact us at nerezdev@gmail.com and attempt to resolve the issue informally. We will try to resolve disputes in good faith.
Any disputes that cannot be resolved informally will be handled by the competent courts or dispute resolution bodies available under applicable law.
If any part of these Terms is found invalid or unenforceable, the remaining parts will remain in effect. The invalid or unenforceable provision will be interpreted or replaced to the maximum extent permitted by law to achieve its original purpose.
These Terms, together with the Privacy Policy and any terms shown at purchase, form the entire agreement between you and us regarding MaxxUp and replace any prior agreements or understandings about the App.
